Welcome to BikeGarageNearMe (“BGNM”, “we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website, apps, and services (collectively, the “Platform”). By using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1) Definitions
- User / Rider: An individual using the Platform to request bike-related services.
- Garage / Partner: A third-party mechanic, service center, or technician offering services through the Platform.
- Booking: A service request raised by a User and accepted by a Garage.
- Featured Ads: Paid promotions by Garages, clearly labeled on the Platform.
2) Nature of Our Service
BGNM is a connector/marketplace platform. We help Users discover nearby Garages and exchange service requests. We do not provide mechanic services. All services are performed by independent Garages, who are solely responsible for quality, timelines, pricing, and compliance. BGNM is not a party to the service contract between User and Garage.
3) Eligibility & Account
- You must be at least 18 years old (or use with parental/guardian consent) to create an account and make bookings.
- You agree to provide accurate information (name, mobile, email, location) and keep it updated.
- Login is typically via OTP; you are responsible for securing your device and OTP confidentiality.
4) Booking Flow & Estimates
- You submit a request (service type, vehicle type, pickup location, notes).
- Nearby Garages may accept your request. Assignment is first-come / best-fit or auto-assigned based on our logic.
- Distance and indicative charges may be shown. These are estimates only; final charges are set by the Garage after diagnosis.
- Garage may update status (en-route, arrived, in progress, completed) and contact you directly.
5) Pricing, Payments & Taxes
- Visit/transport charges are separate from repair/parts charges (unless specified).
- Any per-km or flat fee shown is guidance; Garage may confirm/revise after assessing conditions.
- Parts and labour rates are set by the Garage. Please ask for a breakup invoice.
- Applicable taxes (GST/others) are the responsibility of the Garage and/or paying party as per law.
- If online payments are offered in future, refunds (if any) follow Garage policy and applicable law.
6) Cancellations & No-Show
- You may cancel before a Garage starts travel. Once en-route, a visit fee may apply.
- If Garage does not show within reasonable time, you may cancel and re-book.
- Abusive cancellations or repeated no-shows may lead to restrictions.
7) User Responsibilities
- Provide accurate pickup location and keep your phone reachable.
- Ensure safe access for the Garage (parking rules, gate pass).
- Do not request illegal modifications or tampering.
- Pay agreed fees on time and collect your belongings.
8) Garage Responsibilities
- Maintain required licenses/permits and comply with applicable laws.
- Provide fair estimates and take approval for extra work/parts.
- Use appropriate tools and reasonable skill & care.
- Issue invoice/receipt, and honor warranties (if provided) directly.
9) Location, Tracking & Communications
- We may process geolocation (with consent) for nearby garages and tracking.
- We may send OTPs and service updates via SMS/email/push.
- Do not misuse SOS/emergency features.
10) Reviews & Content
- Reviews should be factual and non-defamatory.
- We may remove abusive/spam/illegal content.
- By submitting content, you grant us a license to display it on the Platform.
11) Prohibited Use
You agree not to scrape/hack/overload systems, impersonate others, post illegal content, bypass flows, or reverse engineer except as permitted by law.
12) Intellectual Property
Platform content, UI, and software are owned by us/licensors. Garages’ names/logos remain their property.
13) Disclaimers
- Platform is provided “as is” and “as available”.
- We do not guarantee availability/quality/pricing of any Garage.
- Estimated distance/time/pricing may vary from actuals.
14) Limitation of Liability
To the maximum extent permitted by law, BGNM is not liable for indirect/incidental/special/consequential damages. Aggregate liability (if any) shall not exceed fees paid to us for the specific transaction.
15) Indemnity
You agree to indemnify BGNM against claims arising from misuse or breach of these Terms.
16) Privacy
Your use is also governed by our Privacy Policy.
17) Third-Party Links & Services
We may link to third-party services. We are not responsible for their policies or availability.
18) Suspension & Termination
We may suspend/terminate access for violation, abuse, fraud, or legal requirements. You may stop using anytime.
19) Governing Law & Dispute Resolution
Governed by laws of India. Courts at Vadodara, Gujarat have exclusive jurisdiction.
20) Changes to Terms
We may update Terms. Continued use means acceptance. “Last updated” reflects latest revision.
